TRANSPORT MANAGER CONTRACT

* The contract of the external transport manager

• The road transport company which uses a external transport manager must be bound by a service provision contract which specifies the responsibilities and missions of the manager.

  
  

  • In this case, the manager can carry out his activity with

    2 companies and 20 vehicles maximum.

    In any case, the

    manager must have a real link with the transport company.

    
    

    • The commercial service provider contract between the transport company and the manager must meet the requirements of DRIEAT - DREAL - DEAL (DROM).
      

* The contract is divided into three parts:

• A part demonstrating the distribution of liability clauses, a guarantee of security and serenity in relations between the company and the manager.

• A part on the definition of the tasks and responsibilities of the transport manager and the transport company towards the service provider.

• A part concerning the delegation of powers which is a legal act binding the delegator and the delegatee. The latter, undertakes by this clause to assume the responsibilities and obligations linked to the powers which have been delegated to him.

* Regarding the internal transport manager:

• Provide the employment contract including the description of the missions (the manager must receive remuneration at the level provided for by the management scale of the collective transport agreement). The missions are listed in Art.R.3113-43 and/or R.3211-43 of the Transport Code.
  
• If the appointment of the manager and the description of his duties are not indicated in the employment contract, attach a copy of the Minutes of the General Meeting for the appointment of the transport manager and an amendment including the description of the duties.
